ADMINISTRATIVE ORDER 1-39.2
IN RE: JUDICIAL ACTION ON CASES WHEREIN THE
CLERK OF COURT
IS ACCEPTING PARTIAL PAYMENTS ON FILING FEES
WHEREAS, Section 57.085, Florida Statutes, provides a procedure whereby prisoners may seek the deferral of prepayment of court costs and fees; and
WHEREAS, Section 57.081, Florida Statutes, provides a procedure whereby an indigent person may receive the services of the court, sheriffs and courts, including filing fees, despite the present inability to pay for such services; and
WHEREAS, Section 28.246(4), Florida Statutes directs the Clerks of the Circuit Court "to accept partial payments for court-related fees, service charges, (and) costs"; and
WHEREAS, this Court has determined that until a complete filing fee is paid, whether an original matter or a matter that is reopened, the matter may not be set for hearing or otherwise be brought before the Court; it is hereby
ORDERED that, unless filing fees are deferred or waived pursuant to Section 57.085 or Section 57.081, no judicial action will take place on any matter in the Family or Circuit Civil Divisions until such time as all filing fees are paid in full.
Administrative Order No. 1-39.1, entered October 12, 2004 is hereby VACATED.
